Pathways Tutoring: Booking and Service Terms & Conditions

1. General Acceptance of Terms

These Terms and Conditions govern the provision of tutoring services by Pathways Tutoring to the parent/guardian ("Client") and the student ("Student"). By booking a session or making a payment, the Client agrees to be bound by these Terms and Conditions.

2. Booking and Availability

  • Advance Booking: All tutoring sessions must be booked in advance and are strictly subject to tutor availability and the student being matched with the appropriate subject and Key Stage (KS1, KS2, or 11+).

  • Initial Consultation: All new Clients are required to complete an initial Pathway Consultation (which may be offered free of charge) to discuss the student's needs, goals, and learning style before regular tuition can commence.

  • Matching: Pathways Tutoring will use its experienced judgment to match the Student with a suitably qualified tutor. While we strive for consistency, the company reserves the right to change the assigned tutor where necessary (e.g., due to illness or scheduling changes).

3. Fees and Payment

  • Session Fees: All fees for tuition services are clearly published on the Pathways Tutoring website or provided in writing to the Client before booking.

  • Payment Schedule: Payment for all sessions must be made in advance. This may be on a monthly retainer basis or at the time of booking an individual session, as agreed upon during the initial consultation.

  • Late Payment: Pathways Tutoring reserves the right to suspend future sessions and/or terminate the tutoring agreement if fees are not settled in accordance with the agreed payment terms.

  • Refunds: Pre-paid fees are generally non-refundable, except where Pathways Tutoring cancels a session and an alternative time cannot be mutually agreed upon.

4. Cancellation and Rescheduling Policy

  • Client Cancellation Notice: The Client must provide a minimum of 24 hours notice to Pathways Tutoring if they need to cancel a scheduled session.

  • Charge for Late Cancellation: If less than 24 hours notice is given, the full session fee will be charged and is non-refundable, as the tutor's time is reserved.

  • Tutor Cancellation: In the rare event a tutor cancels a session, Pathways Tutoring will offer to reschedule the session at the earliest mutually convenient time. If rescheduling is not possible, the Client will receive a full refund or credit for that session.

  • Lateness: If a Student is late for a session, the tutor will wait for the duration of the scheduled time. The session will still end at the scheduled time and no pro-rata refund will be given for the lost time.

  • Rescheduling: Any rescheduling will be at the discretion of the Pathways team and will be communicated to Clients as soon as possible.

5. Disclaimer and Expected Outcomes

  • Best Efforts: Pathways Tutoring and its tutors will use their best professional efforts and qualified expertise to support the Student's learning and help them achieve their goals.

  • No Guarantee of Results: We cannot and do not guarantee specific results, grades, or exam outcomes (such as a guaranteed pass for the 11+ exams). Tutoring is one element of a student's learning, and results depend on numerous factors, including the student's motivation, prior learning, and work outside the session.

6. Termination of Services

  • Client Termination: The Client may terminate the tutoring arrangement, giving a terms notice, at any time by providing written notice to Pathways Tutoring. Any prepaid sessions that fall outside the required cancellation notice period will be credited or refunded.

  • Pathways Tutoring Right to Terminate: Pathways Tutoring reserves the right to immediately terminate the tutoring relationship, without refund for outstanding sessions, if:

    • The Client or Student breaches the Pathways Tutoring Code of Conduct or Behaviour Policy.

    • The Client fails to make timely payments as required.

    • The Student exhibits persistent unmanageable behaviour that compromises the learning environment.

    • We determine that the tutoring relationship is no longer beneficial for the Student.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
